Các trường hợp được nghỉ thai sản 6 tháng

Trường hợp nào được nghỉ thai sản 6 tháng theo quy định của Bộ luật Lao động số 10/2012/QH13? Những trường hợp bắt đầu nghỉ sinh con vào các tháng 9, 10, 11, 12/2012 hoặc nghỉ từ ngày 1/1/2013 thì thời gian nghỉ được tính như thế nào?

 

Theo quy định tại Điều 157 Bộ luật Lao động sửa đổi thì lao động nữ đáp ứng đủ điều kiện về thời gian đóng bảo hiểm xã hội theo quy định của Luật Bảo hiểm xã hội sẽ được nghỉ hưởng chế độ thai sản 6 tháng. Quy định về thời gian nghỉ chế độ thai sản 6 tháng đối với lao động nữ có hiệu lực thi hành từ ngày 1/5/2013.

Theo quy định tại điểm b, khoản 2, Điều 240 Bộ luật Lao động sửa đổi thì: Đối với lao động nữ nghỉ sinh con trước ngày Bộ luật Lao động có hiệu lực thi hành, mà đến ngày 1/5/2013 vẫn đang trong thời gian nghỉ sinh con theo quy định tại Luật Bảo hiểm xã hội thì thời gian nghỉ hưởng chế độ khi sinh con được thực hiện theo quy định của Bộ luật Lao động (6 tháng).

Như vậy, điều cơ bản ở đây là ngày 1/5/2013 lao động nữ vẫn đang trong thời gian hưởng chế độ thai sản theo quy định tại khoản 1 Điều 31 Luật Bảo hiểm xã hội (tùy thuộc vào điều kiện lao động, môi trường lao động của lao động nữ) thì được hưởng tiếp cho đủ 6 tháng.
